Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the website COLORFULCRATES.COM (the "Site"), operated by COLORFUL CRATES LLC ("we," "us," or "our"), including any purchases of dog crates, pet supplies, or related products (collectively, the "Services").  By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or make purchases.  We may update these Terms at any time. Changes will be posted here with a new "Last updated" date. Continued use after changes means you accept them.


1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or purchase from us. By using the Site, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

2. Account Registration

To place orders or access certain features, you may need to create an account. You agree to provide accurate, current information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

We reserve the right to suspend or terminate accounts for any reason, including violations of these Terms.

3. Products and Orders

  • All products (including dog crates) are subject to availability. We may refuse or cancel orders at our discretion (e.g., pricing errors, stock issues).
  • Product descriptions, images, and specifications are for informational purposes only and may contain inaccuracies. Colors may vary due to monitor settings.
  • Prices are in USD and exclude taxes, shipping, and duties (added at checkout). We reserve the right to change prices without notice.
  • Orders are offers to purchase; we accept by confirming shipment.

4. Payment

Payments are processed securely through third-party providers (e.g., Stripe, PayPal).  We do not store full payment card details.  By providing payment information, you authorize us (and our processors) to charge the total amount, including taxes and shipping.  You are responsible for all charges. If payment fails, we may cancel the order.

5. Shipping and Delivery

Shipping times and costs are estimates only. We are not liable for delays caused by carriers, customs, weather, or other events beyond our control.  Title and risk of loss pass to you upon delivery to the carrier (or upon shipment for digital elements, if any).  See our separate Return Policy (linked) for issues with delivery or damaged/incorrect items.

6. Returns and Exchanges

All sales are final except for damaged, defective, or incorrect items, as detailed in our Return Policy (incorporated by reference). We do not offer refunds, returns, or exchanges for change of mind, sizing issues, or other non-quality reasons.

7. Limited Warranty and Disclaimers

Products are sold "as is" and "as available," except as required by law.  We warrant that products will be free from material defects in materials and workmanship at delivery, subject to normal use. This warranty is limited and does not cover misuse, improper assembly, normal wear, or damage from accidents/neglect.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, OR PERSONAL INJURY) ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.  OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages — these limitations may not apply to you.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of products, or infringement of third-party rights.

10. Intellectual Property

The Site, content, logos, text, images, product photos, and designs are our property or licensed to us and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our written permission.  You grant us a non-exclusive, royalty-free license to use any reviews, photos, or content you submit (e.g., product photos with your dog) for marketing or Site purposes.

11. Prohibited Conduct

You agree not to:

  • Use the Site for unlawful purposes
  • Interfere with Site operation or security
  • Attempt to gain unauthorized access
  • Transmit viruses or harmful code
  • Harass, impersonate, or spam
  • Scrape or copy Site content without permission

We may terminate access for violations.

12. Third-Party Links and Services

The Site may link to third-party sites (e.g., carriers, payment processors). We are not responsible for their content, practices, or availability.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of THE STATE OF TEXAS, without regard to conflict of laws principles.

Any disputes shall be resolved exclusively in the state or federal courts of DALLAS COUNTY, CITY OF DALLAS, STATE OF TEXAS.  You agree to submit to their jurisdiction.

14. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, strikes, pandemics, supply chain issues).

15. Severability

If any provision is held invalid, the remainder remains in effect.

16. Entire Agreement

These Terms (plus our Privacy Policy and Return Policy) constitute the entire agreement between you and us.

Return Policy

Thank you for shopping with COLORFUL CRATES!  We strive to ensure every dog crate and accessory arrives in perfect condition.  Due to the nature of our products (large, bulky dog crates and pet supplies), we have a limited return policy focused on quality issues only.


1. Returns for Change of Mind or Preference

All sales are final. We do not accept returns, exchanges, or refunds for change of mind, wrong size selection, buyer's remorse, or any reason not related to damage, defect, or incorrect item received.

2. Damaged, Defective, or Incorrect Items

If your item arrives damaged, defective, or incorrect (e.g., wrong size, model, or color shipped):

  • Contact us within 7 days of delivery (or as soon as reasonably possible after discovery) at contact@colorfulcrates.com
  • Provide photos or video clearly showing the issue, your order number, and any relevant details.
  • Do not dispose of the original packaging or item until we confirm next steps.

Once we verify the issue (usually within 2–3 business days):

  • We will arrange a replacement of the same item at no additional cost to you (including free shipping for the replacement where feasible).
  • In cases where the exact item is unavailable, we may offer a comparable alternative or, at our sole discretion, store credit for the full purchase price (excluding original shipping fees).
  • We do not offer cash refunds except in rare circumstances (e.g., repeated failed replacements) and only at our discretion.

We typically cover return shipping for verified damaged/defective/incorrect items, but you must follow our instructions (e.g., use provided label or approved carrier). Unauthorized returns may not be accepted.

3. Non-Returnable Items

The following cannot be returned or exchanged under any circumstances:

  • Personalized or custom-engraved crates
  • Items marked as final sale/clearance
  • Used crates
  • Items damaged due to customer misuse, improper assembly, or normal wear

4. Process and Timeline

  1. Email us with proof of the issue.
  2. We respond with approval and instructions (including any return label if needed).
  3. Return the item (if required) in original packaging.
  4. Once received and inspected, we process the replacement or credit within 3 business days.

We inspect all returned items. If damage appears caused by the customer (not shipping/manufacturing), we may deny the claim.

5. Shipping Damage

If the crate arrives visibly damaged (e.g., crushed box, broken parts), note it on the carrier's delivery receipt and contact us immediately with photos. Claims with carriers (e.g., UPS, FedEx) must often be filed within a short window — we will guide you.
